The cross-Atlantic trap

Pick the US-domiciled S&P 500 ETF and Italy's IRPEF treats it as ordinary income at progressive rates. Pick the European UCITS and the IRS treats it as a PFIC — top ordinary rate plus interest charge. There is no offshore structure that is invisible to both.

Non-harmonized fund treatment
A US ETF is not on the harmonized fund whitelist, so gains and distributions route through the ordinary progressive brackets — not the 26% capital-gains regime. With regional and municipal surcharges the effective rate can reach roughly 46–47%.

Passive Foreign Investment Company regime
Most Irish and Luxembourg UCITS wrappers trigger Form 8621. The IRS taxes distributions and gains at the top ordinary rate, plus a compounding interest charge on top of unrealized gains. Across a long horizon the PFIC surcharge alone can exceed half of total returns.

Foreign-held wealth tax
All foreign-held financial assets — ETF shares included — carry an IVAFE line at 0.2% per year, always tracked separately from income tax. Brokers report this on Quadro RW; it does not get folded into the IRPEF brackets but it is its own number to maintain.

A 30-day window your broker may not know about
Most Italian brokers do not apply US wash-sale rules. A repurchase within 30 days disallows the loss on the 1040, while the Italy-side minusvalenza still goes into Quadro RT — leaving the two sides out of balance. The fix is process, not paperwork.
